Buncombe County Resident Guilty of State Tax Charges

A Buncombe County woman pleaded guilty in District Court to charges filed by the North Carolina Department of Revenue.
Kerry K. Whealan of 55 Grove St., Apt. 20, Asheville pleaded guilty on Wednesday, Aug. 13 to failure to file and pay the state sales tax. Whealan was the owner of Max & Rosie’s Café located at 52 N. Lexington Ave. in Asheville. The business is now closed.
She received a 45-day suspended sentence and was placed on 18 months of supervised probation. She must also pay back the tax, penalty and interest during her probation.
The charges against Whealan are the result of efforts by the Department’s Asheville Collections Office.
